Most of the time, that’s where you’re going to find the source of funds. The employer, being the trucking company, employed the driver. And if the driver was acting in the course and scope of his work or his job, then yes, you would be able to sue the trucking company. You also typically are gonna see the driver so that that takes away the defense from the trucking company that he was not acting in the course and scope of his job.
